תקנון, תנאי שימוש ומדיניות פרטיות

1. אנחנו מברכים את בחירתכם לגלוש באתר האינטרנט “סינגפור - הנקודה החמה” המופעל בכתובת האינטרנט: https://sghotspot.com/  (״האתר״).
2. “סינגפור - הנקודה החמה” הוא אתר מקוון המתמחה בתיירות בסינגפור. האתר מנוהל ע”י אביחי אלהרר, המתגורר בסינגפור משנת 2013, מכיר את כל המקומות המפורסמים והמעניינים בסינגפור בהיכרות אישית ומעמיקה. אביחי למד בקורס הדרכת טיולים המוכר ע״י ממשלת סינגפור במשך חצי שנה ומוסמך למדריך טיולים על ידי משרד התיירות הסינגפורי. באתר ניתן לרכוש סיורים מודרכים בסינגפור, ליווי יומי עם מדריך בסינגפור, תכנון טיול בסינגפור, שיחת יעוץ לטיול בסינגפור, כרטיסים לאטרקציות (דרך קישורי שותף) ולינה במלונות (דרך קישור שותף). בנוסף, האתר מספק אפשרות לחיפוש וקבלת מידע אודות טיולים בסינגפור, שיתוף וקבלת מידע , ובין היתר, בלוג, מאמרי תוכן, ביקורות, ועוד. (“המידע“). 
3. השימוש באתר:
1. תקנון ותנאי שימוש אלה מהווים הסכם מחייב בינך, בין אם באופן פרטי ובין באמצעות תאגיד (״אתה״) לבין האתר בנוגע לגלישה ושימוש באתר בכל מחשב או מכשיר תקשורת אחר כדוגמת טלפון סלולרי, מחשבי טאבלט וכיו”ב. כמו כן הם חלים על השימוש באתר, בין באמצעות רשת האינטרנט ובין באמצעות כל רשת או אמצעי תקשורת אחרים לרבות גישה לאתר באמצעות הטלפון, אפליקציה או על אמצעי אחר. קרא את התקנון ותנאי השימוש בקפידה, שכן הגלישה באתר וביצוע פעולות בו מעידים על הסכמתך לתנאים הכלולים בתקנון ותנאי שימוש אלו (״התקנון״).
2. האתר שומר את זכותו לשנות את תנאי התקנון, מעת לעת, על פי שיקול דעתו הבלעדי וללא הודעה מוקדמת. מועד החלת השינוי כאמור יהיה מרגע פרסומו באתר.
3. האמור בתקנון מתייחס באופן שווה לבני שני המינים והשימוש בלשון נקבה ו/או זכר הוא מטעמי נוחות בלבד.
4. הגלישה באתר מותרת בכל גיל. פעולה ו/או רכישה באתר של קטין מתחת לגיל 18 מחייבת אישור הורה או אפוטרופוס. 
5. תנאי תקנון זה יישארו בתוקפם בעת השימוש באתר. מבלי לגרוע מכל הוראה אחרת בתקנון זה, האתר שומר על זכותו למנוע מכל גולש את השימוש באתר (לרבות חסימת כתובות IP מסוימות), מכל סיבה או נימוק שהוא (מבלי שיצטרך לספק סיבה או נימוק), בשיקול דעתו הבלעדי, ללא צורך בהודעה מוקדמת או התראה ומבלי שיהיה אחראי לנזק כלשהו עקב החלטתו. כמו כן, האתר רשאי להפסיק את השימוש שלך בו וכל תוכן או מידע שפרסמת בכל עת, ללא אזהרה מראש.
4. הצהרת משתמש:
1. בטרם השימוש באתר, גולשי ולקוחות האתר מצהירים, מאשרים ומסכימים כי ידוע להם:
1. שהשירותים, התכנים הדיגיטליים, המוצרים והמידע המופיעים באתר ניתנים ומסופקים לשם הלימוד האישי בלבד וכל פעולה שתעשה בעקבותיהם תעשה באחריות המשתמש;
2. שללקוחות האתר לא תהיה כל טענה כלפי האתר, מנהליו, עובדיו או מי מטעמו והם לא יהיו אחראים, באופן ישיר או עקיף, לכל נזק לרבות, לגוף, לרכוש או לכל נזק אחר או לכל הפסד אחר, אשר יגרם כתוצאה מקבלת מידע מהאתר ו/או מהתכנים הדיגיטליים ו/או מהמוצרים ו/או מהשירותים המוצעים באתר, אפילו אם האתר הזהיר, המליץ או ייעץ לעניין מסוים או על שירות מסוים ובשום מקרה האתר לא יהווה תחליף או יישא באחריות הלקוח ו/או מקבל השירות. על הלקוח חלה האחריות וכל סיכון חובה עבור נזק לרכושו ו/או לרכושם של צדדים שלישיים, הנובעים מהשימוש ו/או אי השימוש בתכנים הדיגיטליים ו/או במוצרים ו/או בשירותים ו/או  במידע באתר;
3. שכל פעולה שתעשה בעקבות שימוש בתכנים הדיגיטליים ו/או במוצרים ו/או בשירותים ו/או במידע באתר תעשה בזהירות לאחר צפייה ו/או קריאה ו/או השתתפות מלאה שלהם וכי האחריות הבלעדית לכל נזק (אם וחלילה יקרה), מכל סוג שהוא, תהיה על עושה השימוש בשירותים.
4. ששם המשתמש והסיסמה שיקבלו במעמד ההרשמה לאתר, ככל ותהיה דרישה להרשמה, הם אישיים ולא ניתן להעבירם לאחר. כמו כן, תוכן התכנים הדיגיטליים ו/או המוצרים ו/או השירותים הינו קנינו הבלעדי של האתר ואסור להפיץ אותו ו/או לעשות בו כל שימוש שאינו למטרת לימוד אישי;
5. שהאתר ניתן לשימוש כפי שהוא (AS IS) והשימוש בו הוא על אחריותו המלאה של הגולש;
2. הגלישה באתר מותרת בכל גיל. הרכישה באתר מיועדת לבעלי כשירות משפטית מגיל 18 בלבד. רכישה של קטין מתחת לגיל 18 באתר מחייבת אישור הורה או אפוטרופוס. 
1. שבשימוש באתר הגולש לא יפר כל חוק, תקנה או הוראה שלטונית אחרת.
3. האתר אינו מתחייב בנוגע למידת הדיוק או השלמות של תיאורי השירות באתר ולא יישא באחריות לכל שגיאה, טעות או נזק.
5. קניין רוחני:
1. אלא אם צוין במפורש אחרת, כל זכויות היוצרים והקניין הרוחני באתר, לרבות, עיצובים, תמונות, מאגרי מידע, תוכנות, קוד, שמע, וידאו, טקסט (״התוכן״) וכן סמלילים, סימני מסחר וכיו״ב (״הסימנים״) הם בבעלות האתר בלבד, או בבעלות צד שלישי,  שהרשה לאתר או נתן רישיון לאתר לעשות שימוש על פי דין בתכנים או בסימנים ובכלל זה שותפיו העסקיים של האתר.
2. התוכן והסימנים ניתנים כמו שהם ״AS IS״ לשימוש אישי בלבד. אלא אם צוין במפורש אחרת, אין להעתיק, להפיץ, להציג בפומבי, לבצע בפומבי, להעביר לציבור, לשנות, לעבד, ליצור יצירות נגזרות, למכור או להשכיר כל חלק מן הנ”ל, בין ישירות ובין באמצעות או בשיתוף צד שלישי, בכל דרך או אמצעי בין אם אלקטרוניים, מכאניים, אופטיים, אמצעי צילום או הקלטה, או בכל אמצעי ודרך אחרת, בלא קבלת הסכמה בכתב ומראש מהאתר או מבעלי הזכויות האחרים, לפי העניין, ובכפוף לתנאי ההסכמה (ככל שתינתן). 
3. בתנאי שאתה זכאי לגלוש באתר, האתר מקנה לך רישיון מוגבל לשימוש בכל חלק מהתוכן אליו ניתנה גישה ראויה לשימוש  אישי בלבד כמפורט באתר, שאינו מסחרי. 
6. הגלישה באתר:
1. בעת גלישה באתר, אתה מתחייב ומצהיר כדלקמן: (1) הגלישה באתר והשימוש הם באחריותך הבלעדית; (2) הפרטים שהזנת בעת השארת הפרטים באתר ו/או רכישה באתר הם נכונים, עדכניים, מדיוקים ומלאים; (3) ככל ויהיה בכך צורך, במקרה של שינוי פרטים תעדכנם בפנייה לאתר; (4) הנך בעל כשירות משפטית ואתה מסכים לתנאי התקנון; (5) לא תעשה שימוש באתר באמצעים אוטומטיים או לא אנושיים, בין אם באמצעות BOT, סקריפט או בכל דרך אחרת; (6) לא תעשה שימוש בלתי חוקי באתר; (7) השימוש שלך באתר לא יפר כל חוק או תקנה רלוונטיים; (8) לא תעביר את שם המשתמש והסיסמה לחשבונך באתר לאחר; (9) לא תעביר את התכנים המוצגים בחשבונך האישי לאחר.
2. האתר רשאי, למנוע מכל גולש שימוש באתר לפי שיקול דעתו המוחלט. מבלי לגרוע מהאמור לעיל, רשאי האתר למנוע גלישת גולש ו/או לחסום גישתו אליו בכל אחד מהמקרים הבאים:
1. אם בעת השארת פרטים באתר נמסרו במתכוון פרטים שגויים;
2. במקרה שנעשה שימוש באתר לביצוע או כדי לנסות לבצע מעשה בלתי חוקי על-פי דיני מדינת ישראל ומדינת סינגפור, או מעשה הנחזה על פניו כבלתי חוקי כאמור, או כדי לאפשר, להקל, לסייע או לעודד ביצועו של מעשה כזה;
3. במקרה שנעשה שימוש באתר בניסיון להתחרות באתר;
4. אם הופרו תנאי תקנון זה;
5. במקרה שמשתמש העביר לאחר את שם המשתמש והסיסמה לחשבונו האישי ו/או את התכנים המוצגים בחשבונו האישי;
6. אם נעשתה על ידי גולש כל פעולה שתמנע מאחרים לגלוש לאתר או להמשיך ולהשתמש באתר בכל דרך שהיא.
7. הרשאה לדיוור, פרסומים ופרסומת:
1. גולש שהשאיר פרטים באתר ומצורף לרשימת הדיוור של האתר, מאשר שימוש בפרטיו לצורך קבלת מידע שיווקי, עדכונים ופרסומות שיבצע האתר מעת לעת.
2. על גולש שהשאיר פרטים כאמור תחולנה הוראות הדיוור המפורטות בתקנון להלן. 
3. אין להשאיר פרטים של אדם אחר באתר שלא בהסכמתו ו/או ללא נוכחותו מול המסך בשעת השארת הפרטים ולאחר שהוסברו לו כל תנאי התקנון.
4. בעת השארת הפרטים יתבקש הגולש למסור פרטים אישיים כגון: שם פרטי, שם משפחה, וכן כתובת דואר אלקטרוני פעילה. מסירת פרטים חלקיים או שגויים עלולים למנוע את האפשרות להשתמש בשירות ולסכל יצירת קשר במקרה הצורך. במקרה של שינוי פרטים יש לעדכנם באתר.
5. מובהר כי אין חובה על-פי חוק למסור פרטים באתר, אולם בלא למוסרם לא ניתן יהיה לקבל תוכן שיווקי ועדכונים מהאתר. 
6. האתר לא יעשה בפרטים שנמסרו שימוש, אלא בהתאם למדיניות הפרטיות של האתר המהווה חלק בלתי נפרד מהתקנון.
7. השארת פרטים באתר ואישור לקבלת תוכן שיווקי כוללת, בין היתר, קבלת תוכן שיווקי, מידע ביחס למבצעים, עדכונים והנחות המוצעים למשתמשים רשומים.
8. אישור דיוור (קבלת תוכן שיווקי) כאמור, מהווה את הסכמתו של הגולש למשלוח דברי פרסומת על-פי חוק התקשורת (בזק ושידורים) (תיקון מס’ 40) התשס”ח – 2008 (“חוק התקשורת”).
9. מובהר כי באפשרות משאיר הפרטים להסיר עצמו בכל עת מהדיוור באמצעות לחיצה על “להסרה מרשימת התפוצה” שמופיע בתחתית כל דיוור שנשלח או באמצעות פנייה בדוא”ל לאתר. כל עוד לא הסירו עצמו הנרשם מרשימת הדיוור כאמור, רשאי האתר, בכפוף לחוק התקשורת, להעביר לנרשם דיוור ישיר כאמור.
10. אין לראות במידע בדיוור משום הבטחה לתוצאה כלשהי ו/או אחריות לשירות המוצע בו. 
11. הדיוור בכללותו, לרבות כל המידע המופיע בו, מוצע כמות שהוא, ויהיה מדויק ונכון ככל הניתן, ואולם, יתכן והמידע אינו שלם או לחלופין, יתכן ונפלו טעויות טכניות או אחרות במידע.
12. הגולש מאשר כי לא תהיה לו כל טענה בקשר למודעות פרסום ו/או פרסומות המוצגות באתר, לרבות בקשר למיקומן באתר. מובהר כי בכל הנוגע למודעות פרסום המוצגות בחסות צד שלישי, לאתר אין כל התערבות בבחירת הפרסומות המוצגות, אמיתות תוכנן וסדר הופעתן.
8. השירותים המוצעים באתר:
1. השירותים, התכנים הדיגיטליים, המוצרים והמידע יופיעו ויוצגו בדפי האתר.
2. המחיר המופיע באתר בצמוד לשירות הינו המחיר העדכני. המחיר עשוי להשתנות מעת לעת. האתר שומר לעצמו את הזכות לשנות את מגוון התכנים הדיגיטליים, השירותים, המוצרים והמידע או להפסיקם או לשנות את המחירים המוצעים באתר ומחוצה לו, ללא הודעה מוקדמת. 
3. האתר אינו מחויב, בכל דרך שהיא, לקיים מגוון כלשהו של שירותים, תכנים דיגיטליים ו/או מוצרים ו/או מידע.
4. אופן הצגת התכנים הדיגיטליים, השירותים המוצרים והמידע באתר הינו על-פי שיקול דעתו הבלעדי של האתר.
9. הרשמה ורכישה של השירותים, התכנים הדיגיטליים והמוצרים באתר:
1. חלק מהתכנים הדיגיטליים, השירותים ו/או המוצרים המוצעים לרכישה באתר ניתנים לרכישה באופן ישיר ללא צורך בהרשמה לאתר ועבור חלק מהתכנים הדיגיטליים, השירותים ו/או המוצרים המוצעים לרכישה באתר, האתר דורש הרשמה לאתר. 
2. התכנים הדיגיטליים והשירותים יועברו באמצעות פלטפורמת ZOOM או באמצעות כל פלטפורמה מקוונת אחרת שתיקבע על ידי האתר (בהתאם לשירות שהוזמן על ידי הלקוח). התכנים הדיגיטליים והשירותים יסופקו במועד ששוריין על ידי הלקוח, בכפוף לאישורו של האתר. 
3. מתן השירות יתאפשר בכפוף לשיקול דעתו הבלעדי של האתר והאתר לא יהא אחראי לכל איחור ו/או עיכוב במתן השירות ו/או אי-מתן השירות, כתוצאה מכוח עליון ו/או תקלות טכניות ו/או מאירועים שאינם בשליטתו.
4. התשלום בגין הרשמה לתכנים הדיגיטליים, לקבלת השירותים ולרכישת  מוצרים באתר יתבצע באמצעות כרטיס אשראי או בכל אמצעי תשלום אחר המופיע בעמוד התשלום. 
5. בנוסף להוראות התקנון יחולו גם הוראות תקנון חברת הסליקה או אמצעי התשלום האחר. על אף האמור לעיל, האתר שומר לעצמו את הזכות לקבוע הסדרי תשלומים אחרים לנרשמים, והכל על-פי שיקול דעתו הבלעדי.
6. ההרשמה והתשלום באתר יבוצעו בכפוף לאישור העסקה על ידי חברת האשראי. במקרה בו לא אושרה העסקה על ידי חברת האשראי, יקבל הנרשם הודעה וחשבונו לא יחויב בגין העסקה. 
7. כל זכויות היוצרים והקניין הרוחני בתכנים הדיגיטליים, בשירותים, במוצרים ובמידע באתר שייכות לאתר בלבד, השימוש תכנים הדיגיטליים, בשירותים ובמוצרים הוא אישי בלבד ואין להעביר לאחר, להעתיק, להפיץ או להציג בפומבי את השירותים שנרכשו. 
8. תחילת עבודה על שירות תכנון טיול תחל לאחר תשלום על כמחצית מימי תכנון הטיול. תיק  הטיול יסופק במלואו לאחר סיום ההכנות והעברת סכום התשלום הנותר.
10. מדיניות אספקה: 
1. האתר ידאג לאספקת הזמנת מוצרים שבוצעה באתר לכל מקום עליו יסכימו הצדדים בעת ביצוע ההזמנה באתר.
2. הזמנות שיבוצעו באתר יטופלו ויסופקו בלוחות הזמנים:
1. עד 7 ימי עסקים באמצעות שליח עד הבית;
2. איסוף עצמי בתיאום מראש.
   ״יום עסקים״ – ימי ראשון עד חמישי, להוציא ימי שבתון של כלל המשק, ערבי חג וימים בהם הבנקים בישראל לא עובדים.
3. עלות המשלוח עשויה להתעדכן מעת לעת בהתאם לאמור בעת ביצוע ההזמנה באתר.
4. האתר רשאי לקבוע סכום מינימום להזמנה באתר.
5. במקרה שבו מוצר שהוזמן באתר אינו זמין במלאי, האתר יעדכן את המזמין. במידה והמזמין לא יהיה זמין, האתר ישלח את ההזמנה ללא המוצר החסר.
6. במידה והלקוח לא יהיה נוכח בביתו בעת הגעת השליח, בשעה שתואמה אתו מראש, ההזמנה תוחזר ותשלח פעם נוספת לאחר תשלום דמי משלוח נוספים על ידי הלקוח.
7. אספקת הזמנות תתאפשר בכפוף לתנאים הבאים:
1. ישנה נגישות סבירה למקום ההזמנה;
2. האתר (לרבות חברת השליחויות שלו) מבצע חלוקה באותו אזור;
3. אם מדובר בארגון, מוסד, קיבוץ או ישוב שלא ניתן להגיע אליהם ללא אישור מיוחד ו/או שאין בהם רישום מוסדר של רחובות ו/או מספרי בתים, ההזמנה תימסר לנקודת החלוקה המרכזית באותו המקום.
8. האתר לא יהיה אחראי לכל איחור ו/או עיכוב באספקה ו/או אי-אספקה, שיגרם כתוצאה של:
1. כוח עליון ו/או מאירועים שאינם בשליטת האתר;
2. מסיבות הקשורות לחברת השליחויות של האתר;
3. סגירת המשק כך שפעילות האתר ו/או ספקיו ו/או נותני שירותיו יפגעו, מכל סיבה שהיא.
11. מדיניות שינויים וביטולים:
1. בקשה להחזר, שינוי או ביטול עסקה תועבר לאתר באחד מאמצעי ההתקשרות המופיעים בתחתית התקנון. 
2. שינוי או ביטול הזמנת שירותים ו/או תכנים דיגיטליים  הכוללים מפגש חד פעמי, פרונטאלי ו/או מקוון, יתאפשרו בתוך 14 ימים מיום ביצוע העסקה או ממועד קבלת פרטי העסקה (לפי המאוחר), ובתנאי שביטול כאמור ייעשה לפחות שני ימים, שאינם ימי מנוחה, קודם למועד שבו נקבע המפגש.
3. שינוי או ביטול הרשמה לשירות הכולל מספר מפגשים, פרונטאליים ו/או מקוונים, יתאפשרו בתוך 14 ימים מיום ביצוע העסקה או ממועד קבלת פרטי העסקה (לפי המאוחר), וקבלת החזר כספי יחסי בהתאם לתקופה בה ניתן השירות, ככל וניתן. 
4. חלק מהתכנים הדיגיטליים המוצעים לרכישה באתר מעניקים גישה מיידית לצפייה בתכנים הדיגיטליים לאחר הרשמה ותשלום, לכן בשל אופי השירות כאמור, שינוי ו/או ביטול הרשמה לתכנים דיגיטליים לאחר קבלת גישה לתכנים, לא יתאפשרו והרוכש לא יהיה זכאי להחזר כספי כלשהו.
5. החזר, שינוי או ביטול של הזמנת מוצרים יתאפשרו בהחזר כספי או בהחלפה בטווח זמן של עד 14 יום לאחר קבלת הלקוח את ההזמנה.
6. במידה וההחזר, השינוי או הביטול יתבקשו לאחר 14 יום מקבלת המוצר, בקשה להחזר, שינוי או ביטול עסקה יתאפשרו בכפוף לשקול דעתו הבלעדי של האתר. 
7. החזרה, שינוי או ביטול יאושרו לאחר שהלקוח יקבל הודעה בכתב מהאתר המאשרת זאת.
8. במקרה שהחזר, שינוי או ביטול נעשו מפני שהלקוח התחרט (ולא עקב פגם או אי התאמה) ואושרו על ידי האתר:
1. על הלקוח להשיב את המוצר לאתר כאשר הוא במצבו כפי שקבל אותו;
2. לא נעשה במוצר שימוש מכל סוג שהוא;
3. המוצר יוחזר בצירוף חשבונית עסקה או הוכחת עסקה;
4. העלויות הכרוכות בהחזרת ההזמנה תחולנה על הלקוח;
5. יגבו דמי ביטול בגובה 5% מסכום המוצר או בסך 100 ש״ח (לפי הנמוך מבניהם). 
9. במקרה שהחזר, שינוי או ביטול נעשו עקב פגם במוצר, האחריות לאיסוף או החלפת המוצר הפגום מהמקום בו נמסר, תחול על האתר. 
10. מוצר שיוגדר כפגום על ידי הלקוח ייבדק על ידי האתר. במידה ולאחר בדיקת האתר המוצר ימצא תקין ו/או שהפגם נעשה לאחר קבלת הלקוח את המוצר כתוצאה של שימוש שאינו סביר, הלקוח לא יקבל החזר כספי ויהיה באפשרותו לבקש את שליחת המוצר חזרה אליו בכפוף לתשלום דמי משלוח פעם נוספת. 
11. כל החזרה, שינוי או ביטול יאושרו לאחר שהלקוח יקבל הודעה בכתב מהאתר המאשרת זאת.
12. החזר הכספי יינתן, ככל הניתן, באמצעי התשלום שבו ביצע הלקוח את ההזמנה.
13. יובהר, כי דמי הרשמה שישולמו על ידי הרוכש עבור התכנים הדיגיטליים ו/או השירותים המוצעים לרכישה באתר, לא יוחזרו בשום מקרה וכי לרוכש לא תהא כל תביעה ו/או טענה כנגד האתר ו/או המכון בגין כך.
14. ניתן לבטל שירות סיור פרטי או ליווי, שנירכש באתר, עד שלושה ימים לפני הסיור. מהסכום המוחזר (ערך הסיור שנרכש) יופחתו 10%, אשר ישמשו כדמי ביטול. לא ינתן החזר כספי על סיור שבוטל ביום בו אמור הסיור להתקיים. במקרים חריגים יופעל שיקול דעת ע״י הנהלת האתר.
15. החזר עבור פיקדון אשר שולם עבור שירותי הדרכה דרך האתר (בדרך כלל לקבוצות מעל 10 אנשים), ינתן לאחר בקשת ביטול אשר הוגשה לא פחות מחודש לפני מועד ביצוע ההדרכה אשר סוכם בין ״סינגפור - הנקודה החמה״ לנציג או נציגי הקבוצה. מהסכום ההחזר (ערך השירות שנירכש), יופחתו 10% אשר ישמשו כדמי ביטול.
16. האמור בתקנון זה ובסעיף 9 לעיל כפוף להוראות חוק הגנת הצרכן, התשמ”א-1981.
12. אחריות האתר:
1. אין לראות במידע המופיע באתר משום הבטחה לתוצאה כלשהי ו/או אחריות לאופן הפעילויות של השירותים המוצעים בו. האתר לא יהיה אחראי לשום נזק, ישיר או עקיף, אשר ייגרם לגולש כתוצאה מהסתמכות על מידע המופיע באתר ו/או בקישורים לאתרים אחרים ו/או כל מקור מידע פנימי ו/או חיצוני אחר ו/או שימוש בשירותים אשר מוצגים על ידו.
2. מידע ומצגים אודות שירותים המוצגים באתר, שמקורו בשותפיו העסקיים של האתר ששירותיהם מופיעים באתר (ככל ויופיעו) וכל תוכן ביחס לשירותים נמצאים באחריותם הבלעדית של השותפים העסקיים כאמור, ועל כן, מובן שלאתר אין כל אחריות בגין מידע מעין זה, ואין האתר ערב למידת הדיוק של מידע זה.

8. כל תוכנת מחשב, קוד מחשב או יישום הכוללים נגיף מחשב (וירוס) לרבות תוכנות עוינות ויישומים מזיקים למיניהם;
9. כל תוכן המהווה לשון הרע על אדם, או הפוגע בפרטיותו או בשמו הטוב;
10. כל תוכן בעל אופי או תוכן טורדני, מעליב, עוין, מאיים או גס רוח;
11. כל תוכן שיש בו, או הוא מעודד לגזענות או אפליה פסולה על בסיס כלשהו;
12. כל תוכן המעודד ביצוע עבירה פלילית או עלול להוות בסיס לתביעה אזרחית;
13. כל תוכן המנוגד לכללי השימוש המקובלים באינטרנט או העלול לגרום נזק או לפגוע במשתמשי אינטרנט בכלל ובמשתמשי האתר בפרט.
2. האתר רשאי לסרב לפרסם או למחוק לאלתר כל תגובה ו/או תוכן שנמסר לפרסום בכל עת שימצא כי הופרו תנאי התקנון או שתכנים שפורסמו פוגעים או עלולים לפגוע בשירותים הניתנים באתר, במשתמשיו, באתר או במי מטעמו. בנוסף, האתר יהיה רשאי במקרה זה למנוע מגולש מלפרסם תגובות ו/או תכנים נוספים באתר ו/או לחסום את גישתו לאתר. הוראות סעיף זה מוסיפות על זכויות האתר על פי כל דין.

11. לאחזר, לפענח או להנדס לאחור חלק מהאתר, אפשרות באתר או יישום באתר;
12. להטריד, להפחיד או לאיים על כל אחד מעובדי או סוכני האתר;
13. למחוק את זכויות היוצרים או את הודעת הזכויות הקנייניות מכל תוכן או סימן;
14. להעתיק או להתאים את  קוד האתר או חלק ממנו, כולל אך לא רק Flash, PHP, HTML, JavaScript או קוד אחר;
15. להעלות או להעביר (או לנסות להעלות או להעביר) וירוסים, סוסים טרויאניים, או חומר אחר, כולל שימוש בדואר זבל, אשר יפריע לשימוש באתר;
16.  לבצע פעולה שתפגע או תזיק לאתר, בהתאם לשיקול דעתו של האתר;
17. להשתמש באתר באופן שאינו עולה בקנה אחד החוק, התקנות והפסיקה.
